    Housing built before 1978 may contain lead-based paint. Lead paint, paint chips and dust can cause health hazards if not managed properly. Before renting pre-1978 housing, landlords must disclose the presence of lead-based paint hazards in the dwelling.

    Most courts will accept a “reasonable” late fee as one being under 5% of monthly rent. States that are exceptions to this include:

    Maine:

    Late fee can be maximum of 4% of monthly rent

    Arizona:

    Late fee cannot exceed $5 charge per day late.

  • A late fee should not be charged immediately; a period of  at least 5 days should be granted before a fee is charged. Landlords of properties in the following states have to allow for a longer grace period:

    Connecticut:9 Day grace period

    Maine: 15 Day grace period

    Massachusetts: 30 Day grace Period

  • What fine will the Tenant be charged for returned/bounced checks?

    In many situations, a $20 fee for a bounced check is a reasonable request.
    States have different rules regarding how much can be charged for bounced or returned checks. For instance, a landlord in California can charge $25 for the first bounced check and $35 for each additional bounced check. The most a landlord can charge in Texas is $30; in New York the limit is $20; in Washington the charge cannot exceed $40. Please check with the rules of your state regarding bounced check fees.

  • For states that have limits on the maximum security deposit charged (see previous section), the pet deposit is included in that maximum limit. Therefore, the pet deposit in addition to the security deposit (added in the previous section) cannot exceed the state's security deposit limit.

    Alaska, Delaware, Hawaii, North Dakota: 

    Additional 1 month’s rent as pet deposit

    Alabama, North Carolina:“Reasonable” amount for additional pet deposit

    Nebraska: 

    Additional ¼ month rent as pet deposit

    Kansas: 

    Additional ½ month rent as pet deposit

    New Jersey: 

    Can charge 10% current security deposit for additional security (including pet) deposits
